In Annex 1 of Title II of Vlarem, you will find the classification list of activities and establishments that can cause nuisance or risks to people and the environment. These activities and establishments are classified under various headings.
The threshold values, listed in the classification list, generally relate to production capacity or capability. In the third column of the list, you can find the class associated with a specific heading. The highest class of the different headings determines your company’s class.
Since 2018, building and environmental permits were merged into the environmental permit and must be applied for simultaneously via the government’s environmental counter.Depending on the nature of your application (transfer, renewal, notification, application, etc.) and the class of your business, specific information will need to be supplied.
Companies and activities requiring an environmental licence are classified into three classes, depending on their environmental impact:
- Class 1: The most polluting activities, such as chemical plants, large waste treatment plants or power plants, fall under this class. A comprehensive environmental licence is required, sometimes supplemented by an environmental impact report (EIR). These applications are dealt with at provincial or Flemish level.
- Class 2: These companies have a medium impact on the environment and also have to apply for environmental permits, but the procedure is less strict than for class 1. Applications are handled by the municipality. Applications are handled by the municipality.
- Class 3: These companies have a limited impact on the environment. They are not required to apply for an environmental licence, but must report to the competent authority, being the municipality.
The licence should be reapplied for under the following circumstances:
The end date of the licence is about to expire.
The company’s activities change or expand.

The former environmental permit was (usually) granted for a period of 20 years. The new environmental permit is permanent in nature and therefore no longer has an expiry date, but must be regularised if activities change or expand.
No, an environmental permit consists of several components. The former building permit is now applied for through the urban planning section of the environmental permit and is usually drafted by an architect. The former environmental permit goes through the environmental section (IIOA establishments), where our environmental experts can provide the necessary support and take care of the application for you.
